The Democratic Memory Law was issued through Law 20/2022 of October 19, opening the possibility of acquiring Spanish nationality for individuals with specific historical and family links to Spain.

  • Individuals born outside Spain whose parents or grandparents suffered exile for political, ideological, or related reasons and consequently lost or renounced Spanish nationality.
  • Individuals born abroad to Spanish women who lost their nationality due to marriage prior to the 1978 Constitution.
  • Adult children of individuals who obtained Spanish nationality under Law 52/2007 relating to historical memory.

Those meeting these criteria may apply for Spanish nationality under the provisions of this law.

What to Prepare to Avail of the Rights of the Democratic Memory Law?

Applicants must prepare a structured set of documentation to support their application and demonstrate eligibility under the law.

  • Formal request to exercise the right of option
  • Appointment of a legal representative where applicable
  • Proof of identity through a valid passport
  • Birth certificate of the applicant, duly legalized or apostilled
  • Spanish birth certificate of the relevant parent or ancestor
  • Criminal record certificate where appropriate

Notably, language tests such as CCSE or DELE are not currently required under this law, which simplifies the application process compared to other nationality routes.

This limited window reflects previous legislative experiences, where similar rights introduced under earlier laws were later discontinued following political changes.
